1. The service
TenantPeak provides property management software and operations support for Realtors, brokerages and property managers (our clients), and a portal where their property owners and tenants can see their records, statements, payments, maintenance requests, documents and messages.
2. Your account
- Portal accounts are created or approved by TenantPeak or by our client. Give accurate information and keep it up to date.
- Keep your password private and do not share your account. You are responsible for what happens under your login.
- Tell us right away at hello@tenantpeak.com if you think someone else has used your account.
- Each person sees only the records their role allows (office, realtor, owner or tenant). Do not try to reach anything else.
3. Acceptable use
You agree not to:
- use TenantPeak for anything unlawful, fraudulent or harmful, including discrimination prohibited by the Ontario Human Rights Code;
- try to access other people's accounts or records, test or break the security of the service, or get around its limits;
- upload viruses or harmful files, or content you do not have the right to share;
- copy, scrape, resell or overload the service, or use it to send spam;
- enter personal information about someone without a lawful reason and any consent the law requires.
4. Your information and records
- Records our clients put into TenantPeak belong to them. We use them only to provide the service, as described in our Privacy Policy.
- Whoever enters a record is responsible for its accuracy and for having the right to enter it, including any consent needed from owners and tenants.
- Files you upload stay yours. You give us permission to store, process and display them only as needed to run the service.
5. Tenancy tools are not legal advice
TenantPeak includes tools that follow Ontario's Residential Tenancies Act, such as rent-increase timing, entry-notice timing, deposit limits and arrears worksheets. They are aids to help you get the figures and dates right; they are not legal advice and do not replace the official Landlord and Tenant Board forms or guidance. Always check the current rules and forms before serving a notice or taking action, and get legal advice when you need it.
6. Financial information
Balances, statements, receipts and reports are calculated from the records entered in the portal. They are not accounting or tax advice. Please check them, and tell your Realtor or property manager, or us, about anything that looks wrong.
7. Emails and notices
Using the portal includes receiving service emails, such as invitations, password resets, statements, payment confirmations and rent reminders, as listed in our Privacy Policy. Keep your email address current so they reach you.
8. Fees
Fees for our clients are set out in their own agreement with TenantPeak; pricing is available on request.
9. Availability and changes
We work to keep TenantPeak available, secure and accurate, but we cannot promise it will always be uninterrupted or error-free. We may improve, change or stop features, and may pause the service for maintenance. We will give reasonable notice of significant changes where we can.
10. Disclaimers and liability
To the extent the law allows, TenantPeak is provided "as is", and TenantPeak is not liable for indirect, incidental or consequential losses, such as lost profits or lost data, arising from use of the website or portal. Nothing in these terms limits any right you have under laws that cannot be excluded, including Ontario consumer protection law.
11. Ending access
You can stop using TenantPeak at any time. We, or our client, may suspend or end an account that breaks these terms or puts the service or other people at risk, or when a client's agreement ends. Records are then kept or deleted as described in our Privacy Policy.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
13. Changes and contact
We may update these terms; the date at the top shows the latest version, and we will tell portal users about significant changes. Questions: hello@tenantpeak.com.
